FCC EB Enters into Consent Decree with DISH Wireless re: Z-Axis Compliance

On November 21, 2024, the FCC’s Enforcement Bureau issued a Consent Decree resolving an investigation into DISH Wireless, a subsidiary of EchoStar, for failing to deploy required vertical location technology for 911 calls in top 25 markets pursuant to section 9.10(i)(2)(ii) and (iii) of the FCC’s rules.

DISH launched its 5G Voice over New Radio (“VoNR”) service without deploying either dispatchable location or z-axis information for wireless 911 calls, and agreed to pay a $100,000 penalty to settle the case.  DISH noted that as of March 6, 2024, DISH had deployed and was making available z-axis location information to PSAPs associated with wireless 911 calls received on its voice network.

The FCC terminated the investigation, contingent on DISH’s future compliance, emphasizing the importance of public safety in wireless communication.
