November 9, 2023 Weekly Wireless Wrap-Up

Good afternoon from Washington, DC!  Below you will find this week’s Wireless Wrap-Up; your update on the wireless telecommunications regulatory landscape, important wireless decisions, and more!  Here is your wrap-up:

  • OPEN MEETINGS
    • On 11/8, the FCC released the Agenda for the November Open Meeting, scheduled for Wednesday, November 15, 2023 at 10:30 AM. The FCC is scheduled to consider nine items, including a Report and Order and Further Notice of Proposed Rulemaking on preventing digital discrimination, a Report and Order adopting rules to implement the Safe Connections Act, a Notice of Inquiry on artificial intelligence and robocalls, and a Report and Order and Further Notice of Proposed Rulemaking on SIM Swapping and Port-Out Fraud.  For more information and to view a copy of the Agenda, see our post here.
  • UNLICENSED USE OF THE 6 GHZ BAND
    • On 11/1, the FCC released a Second Report and Order, Second Further Notice of Proposed Rulemaking, and Memorandum Opinion and Order, allowing operation of very low power (“VLP”) unlicensed devices in two portions of the 6 GHz band, seeking comment on additional portions of the band that VLP devices should be permitted to operate in, and addressing a remand from the District of Columbia Circuit of the FCC’s 2020 Report and Order allowing unlicensed use of the 6 GHz band.  The Item was adopted at the October Open Meeting.  For more information and to view a copy of the item, see our post here.
  • STATE OF BROADBAND REPORT
    • On 11/1, the FCC released the Seventh Section 806 Notice of Inquiry (“NOI”) seeking comment on the availability of advanced telecommunications capability to all Americans and proposing new speed benchmarks for broadband. Comments are due by December 1, 2023; reply comments are due by December 18, 2023.  For more information and to view a copy of the NOI, see our post here.
  • BRINGING PUERTO RICO TOGETHER FUND AND CONNECT USVI FUND
    • On 10/31, the Wireline Competition Bureau and Office of Economics and Analytics released a Public Notice announcing that they had approved parameters and a testing methodology that mobile support recipients of the Bringing Puerto Rico Together Fund and the Connect USVI Fund may use to submit network data to verify they have met their deployment obligations.
