Sixth Circuit Grants Stay of Net Neutrality Regulations

On August 1, 2024, the Sixth Circuit Court of Appeals stayed the FCC’s net neutrality order pending final review of the pending appeals.

The Court found that the appellants “have shown that they are likely to succeed on the merits and that the equities support them.” The Court also noted that “net neutrality is likely a major question requiring clear congressional authorization,” and the FCC “failed to satisfy the high bar for imposing such regulation.”

The Court directed oral arguments on the appeal to occur between October 28-November 1, 2024.
