FCC Publishes SCS Item in Federal Register

On April 30, 2024, the FCC published in the Federal Register the Report and Order and Further Notice of Proposed Rulemaking (“R&O” and “FNPRM” respectively) adopting a Supplemental Coverage from Space (“SCS”) framework, which will enable satellite-to-device connectivity.

The R&O is effective May 30, 2024, except for the following provisions:

  • Amendments to § 1.9047(d)(2), Special provisions relating to spectrum leasing arrangements involving terrestrial spectrum rights for supplemental coverage from space, which requires applicants to submit a certification and provide a description with their lease application, are delayed indefinitely.
  • Amendments to § 9.10(t)(3)-(5), 911 service, which requires CMRS providers that utilize SCS arrangements to expand their coverage areas to maintain records of all SCS 911 voice calls and text messages received on their network and at their emergency call center, file an annual report with the Commission on their SCS 911 calls and texts, submit certifications of their compliance with these requirements, and notify subscribers of the limitations of SCS 911 services, are delayed indefinitely.
  • Amendments to § 25.125(b)(1)-(2) and (c), Applications for supplemental coverage from space (SCS), which requires applicants to submit certifications and a comprehensive proposal with their applications, and establishes the equipment authorization requirements for SCS earth stations, are delayed indefinitely.

The FCC will publish a future notice in the Federal Register announcing the effective date of the delayed provisions.

Comments on the FNPRM are due on or before May 30, 2024.

Reply comments on the FNPRM are due on or before July 1, 2024.
